PART THREE

Work permits Exemptions and Limitations of work permits

Term work permit

Article 5 — If otherwise not stipulated by the bilateral or multilateral agreements Turkey is part of, term work permits will be given up to 1 year according to the domestic labor market, developments in the employment life, sectorial and economic conjectural changes, duration of the foreigner’s residence permit, work permit, term of business, being worked in a particular profession, business or work place.

After one year of legal working work permit may be extended for 3 year if employee continue to work in same profession, and at the same work.

After three years of legal working, work permit can be extended up to 6 years provided that to work in the same profession with a desired employer.

If employee who came to Turkey to work brings together or later spouse or children and if they legally reside in Turkey continuously for 5 years, they can able to receive term work permit.

The Department may extend or restrict the geographical area of the term work permit.

Indefinite work permits

Article 6- If otherwise not stipulated by the bilateral or multilateral agreements Turkey is part of, foreign worker who legally and continuously resided and worked in Turkey for 8 years will be granted with Indefinite work permits without considering domestic labor market, developments in the employment life, particular workplace, profession , civil or geographical area.

Independent work permit

Article 7- Foreign workers will be granted Independent work permit by the Ministry if they legally and continuously work and reside in Turkey.

Exceptional circumstances

Article 8- If otherwise not stipulated by the bilateral or multilateral agreements Turkey is part of,

a) A foreign citizen who is married to a Turkish citizen and living in marital union in Turkey with spouse or after 3 years of maritial union if marriage dissolve and foerign citisen continue to reside in Turkey , and children from Turkish citizen,

b) Persons who lost their Turkish citizenship under 403 numbered Turkish Citizenship Law article 19,27, and 28 and their subordinates

c) To foreigners that were born in Turkey or have come to Turkey before reaching their majority according to their national laws, if they don’t have a nation, according to the Turkish legislation and that have graduated from vocational school, high school or university in Turkey,

d) To foreigners that are accepted as an emigrant, refugee or nomad according to the Residence Law number 2510,

e) To citizens of the countries that are a member of the European Union and to the spouses and children thereof who are not citizens of the countries that are a member of the European Union,

f) To those who are working at the service of the diplomats, administrative and technical personnel that are commissioned in the foreign governments’ embassies and consulates in Turkey and in the representations of the international establishments, and to the spouses and children of the diplomats and administrative and technical personnel commissioned in the embassies, consulates and representations of the international establishments in Turkey, provided that they are within the framework of the principle of reciprocity and they are restricted with the duration of the commission,

g) To foreigners who will temporarily come to Turkey for a period of over one month with the aim of scientific and cultural activities, and for a period of over four months with the aim of sports activities,

h) To foreigners at the position of key personnel to be employed in the works of goods and services purchase, having a work made or operating a facility, with contract or tendering procedures by the Ministries and public institutions and establishments authorized by law.

Without being dependent to the durations provided in this Law, working permission may be given;
